Big cities like Philadelphia are responsible for providing reliable transportation for the public, but those options need to be absolutely safe for riders, and also for pedestrians and motorists as a train or bus travels through the city. Bus stops and train stations should be designed to keep passengers and everyone nearby safe.
Devastating accidents involving SEPTA trains are not rare occurrences. The Philadelphia Inquirer charted recent collisions and highlighted three in 2017 alone. In August of 2017, a Norristown train crashed at 69th Street injuring 32 people. Earlier that year in January, two Route 10 trolleys collided in West Philadelphia injuring 46 victims. And in February a crash of a Market-Frankford train badly injured an operator.
These lapses in safety on city trains can devastate victims and leave families to rebuild their lives.
A man was hit by a SEPTA train in Philadelphia Wednesday morning. CBS3-TV reports the accident happened around 5:30 a.m. at the 15th Street Station in Center City on December 30, 2020.
Police say the victim died after falling onto the tracks and being struck by the SEPTA train. CBS3 was told the man was involved in a fight when he fell in front of the train.
The accident involved a train on the Market-Frankford Line.
When basic precautions aren’t considered in the design of public transportation and a tragedy occurs, city governments and departments must be held liable for their negligence.
These accidents can leave victims to heal from horrible injuries and can also rob a family of a cherished loved one. The family can soon face ambulance expenses and funeral costs all coming due after an accident that wasn’t the victim’s fault. They can also have the financial support the victim provided the family through his or her job suddenly disappear.
Families facing a financial crisis while still grieving their loss are allowed to file a wrongful death claim against those responsible for a deadly accident. In the case of a SEPTA train accident, the city may have to accept liability in any death that results from one of their vehicles.
Proper safeguards and detection systems may not have been in place to alert train operators to someone in danger. A train operator can also be investigated to see if they made an error in judgment. If an accident happened as a direct result of security issues around a train station, then city governments can be held liable. All of these issues and more can be investigated by an attorney after a tragic accident.
If you or a loved one were the victims of a Philadelphia train accident, please don’t leave your future to chance. Accidents involving a transportation agency like SEPTA operate under special rules. If you intend to bring a wrongful death claim against the city, you have only 6 months to inform them of your intentions. An experienced SEPTA train accident attorney can represent your family members in this claim and gather the evidence and documents needed to build a strong case.
