Police have arrested a second person in the injury accident involving a crossing guard in Port Richmond. On Tuesday, January 28, 2020, a 61-year-old crossing guard was struck by a Nissan Versa that had run a red light, hit an SUV and then spun into the crossing guard.
On Friday, January 31, 2020, police arrested the driver of the SUV on charges of driving a stolen vehicle and leaving the scene of an accident. The driver of the Nissan Versa was arrested a second time as he left the hospital prior to treatment, but police picked him up the next day.
Police say that the victim sustained serious injuries including multiple fractures and head trauma. Hospital officials say she is facing a long recovery.
Liability for Multiple Vehicle Car Crash
When there are multiple drivers involved in a car crash, the law allows for a percentage of blame to be placed on each driver—including the victim—and each party is responsible for their percentage of the injuries and damages.
In cases where the victim had no liability, both at-fault driver’s insurance companies would pay for 100 percent of the damages up to the policy limits. However, if one of the drivers was driving a stolen vehicle, then the insurance company for that driver won’t pay any portion of the damages. In those cases, if there is not enough insurance to pay for all the damages, the victim can use their own insurance if they have uninsured and underinsured auto insurance.
