At minimum, a personal injury lawsuit is designed to recover lost wages, medical bills, expenses of home care and maintenance, and other economic damages (tangible bills). However, you may also be able to recover certain other types of damages, all of which fall under the non-economic (less tangible, subjective) category. Common categories of damage recovery in most personal injury lawsuits include:
- Pain and suffering;
- Loss of consortium (deprivation of normal marital relations);
- Loss of future earning potential;
- Reputation-related damages (Similar to libel or slander); and
- Loss of life enjoyment.
While these categories of damages are highly subjective, they are common in personal injury lawsuits. Some states subject non-economic damages to caps or limits, but neither Pennsylvania nor New Jersey do.
Both states do, however, put caps on the third category of damages. Punitive damages are rare, but sometimes they will be awarded when a jury determines that a defendant’s conduct was ‘outrageous,’ malicious or wanton. The sole purpose of such an award is to punish the defendant, and as such, juries may levy an award that is out of proportion with the scope of harm. Damage caps help reduce outsized verdicts while still compensating victims of harm.

Some people think, especially if an accident is minor, that they can handle bringing the suit or negotiating with the insurance company themselves. However, it is almost never a good idea.
