Determining fault
In most accidents, unless you were rear-ended while sitting at a red light, determining fault is difficult. Insurers know this and unfortunately, they use it against you. Did both drivers play a role? Was it the bus driver’s fault? What happened? What people need to be aware of in case like this is that establishing negligence is necessary in a personal injury or wrongful death case. Injured parties have a burden of proof and must show what a negligent party did to cause injury. If another driver caused an accident, an experienced New Jersey personal injury attorney will leave no stone unturned when discovering evidence in an accident case and will work to prove negligence such as distracted driving or failure to yield.
