Traffic in Kensington can reach extreme levels in the evenings and that can put anyone on foot trying to get around the city at tremendous risk. Careless drivers can be observing anything other than the road when they miss spotting a pedestrian crossing the street and make an error that causes a tragedy.
The heartbreaking cases of pedestrian accidents were on the rise in 2020 according to Philly Voice. Through October, the city had documented 42 pedestrians who had lost their lives. That number was up from 30 fatalities in 2019 over the same period.
These cases only highlight the need for drivers to show pedestrians more caution and for the city of Philadelphia to provide safer streets and sidewalks for everyone traveling on foot.
A woman hit by a car in Philadelphia on Saturday night passed away from her injuries. WPIV-TV reported the tragic accident happened around 7 p.m. in the West Kensington area of the city on Allegheny Avenue near B street on January 2, 2021.
Philadelphia police say a 75-year-old woman was crossing the street when she was struck by a Honda Civic traveling west. The victim was taken to Temple University Hospital where she was pronounced dead.
The 29-year-old man driving the Civic left the scene but then returned. He has been arrested and charged with homicide by vehicle. A witness who watched the accident unfold from a SEPTA bus says the driver was trying to pass another car when the collision occurred.
Careless drivers can be distracted from the road or be driving recklessly and put pedestrians at extreme risk. Once a tragic accident occurs nothing can bring back the victim and families can be left with only their memories of a beloved family member. What’s more, a family can also be targeted by bill collectors and dishonest insurance agents while they are still grieving their loss.
Families can face the cost of a funeral and ambulance and hospital bills without any certainty that they’ll get help from the driver who caused the accident. The driver’s insurance company should be first in line to help families who are the victim of a tragedy. But sometimes families have to put pressure on insurance representatives to do what’s right.
A family is permitted to file a wrongful death lawsuit against insurance companies for drivers responsible for fatal accidents. This claim for damages is intended to make sure families are not financially decimated by these costs. A claim can also see that close relatives like a spouse or children are taken care of in the years to come as they face future life events without the emotional and financial support the deceased victim would have provided.
A family going through the tragic loss of a loved one due to the negligence of a careless driver should know their rights. A spouse or domestic partner and children of the deceased are allowed to file a wrongful death claim on behalf of the entire family. An attorney can also bring this claim forward for the family and investigate the factors of the case to make sure the driver’s insurance company can’t deny your right to compensation.
